서비스 이용약관
Article 1 (Purpose)
These Terms and Conditions are intended to define the rights, obligations, and responsibilities between the Company and its Members in relation to the use of e-commerce services (hereinafter referred to as "Services") provided through the ND CAREON+ website and mobile application (hereinafter referred to as "Site") operated by Namdo Market Co., Ltd. (hereinafter referred to as "Company").
Article 2 (Definition of Terms)
① "Services" refers to the B2B2C welfare mall e-commerce services through which the Company provides products registered in wholesale markets (Namdaemun, Dongdaemun, etc.) to organizations, and members belonging to such organizations can purchase them.
② "Organization Administrator" refers to a person who has entered into a contract with the Company and has the authority to approve and manage the use of Services by members belonging to that organization.
③ "Member" refers to a person who has been approved by an Organization Administrator, registered on the Site, and is eligible to order products from the welfare mall.
④ "Wholesale Member (Seller)" refers to a business operator who registers and sells products on the Company's B2B platform (ND MARKET).
⑤ "Non-Member" refers to a person who uses the Services on a limited basis without registering for membership.
⑥ "ID" refers to the email address set by the Member and approved by the Company for member identification and Service use.
⑦ "Password" refers to a combination of letters and numbers set by the Member for identity verification.
⑧ "Refund" refers to the return of payment amounts when a transaction is canceled or terminated in accordance with the Electronic Commerce Act and the Consumer Protection Act.
⑨ Terms not defined in these Terms and Conditions shall be governed by relevant laws and general commercial practices.
Article 3 (Disclosure, Explanation, and Amendment of Terms)
① The Company shall post the contents of these Terms and Conditions on the initial screen or a linked screen of the Service so that Members can be informed.
② The Company may amend these Terms and Conditions to the extent that they do not violate relevant laws such as the Act on the Regulation of Terms and Conditions and the Electronic Commerce Act.
③ When amending the Terms and Conditions, the Company shall specify the reason for the amendment and the effective date, and shall provide notice at least 7 days prior to the effective date along with the current Terms. However, for amendments unfavorable to Members, notice shall be provided at least 30 days in advance.
④ Members have the right to disagree with the amended Terms and Conditions. If they do not agree, they may terminate their Service use agreement.
Article 4 (Supplementary Rules)
Matters not stipulated in these Terms and Conditions and the interpretation thereof shall be governed by the Electronic Commerce Act, the Consumer Protection Act, the Act on the Regulation of Terms and Conditions, the Personal Information Protection Act, and other relevant laws and general commercial practices.
Article 5 (Provision and Modification of Services)
① The Company provides the following services:
- Welfare mall operation service based on wholesale products
- Product order and payment processing service
- Namdo Market direct pickup and consolidated packaging delivery service
- Organization-level member management service
- Customer center consultation, exchange and refund support service
- Customized product recommendations, promotions, and other value-added services (with Member consent)
② ND CAREON+ Services are, in principle, based on B2B contracts entered into between the Company and the subscribing organization (Organization Administrator).
③ Product orders are notified to sellers (Wholesale Members) under the name of the subscribing organization, and the Company directly picks up and inspects the products from the wholesale market before shipping them to the organization's members through consignment delivery.
④ The Company may modify or suspend some or all of the Services being provided if there are unavoidable circumstances, and shall provide prior notice.
⑤ The Company shall not provide any compensation for changes or suspension of free services. However, for paid services, refunds or alternative services shall be provided within a reasonable scope.
Article 6 (Membership Registration and Establishment of Use Agreement)
① Membership registration is established when a member agrees to the Terms and Conditions, enters their member information, and obtains approval from the Organization Administrator and the Company.
② The Company may reject membership registration or terminate it retroactively in the following cases:
- False information or omissions
- Identity theft
- Use of Services for illegal or fraudulent purposes in violation of laws
- Lack of approval from the Organization Administrator
③ The approval status and eligibility of members are entirely at the discretion of the Organization Administrator.
④ The Company (Namdo Market) shall not bear any responsibility for damages caused to the organization or third parties due to errors in approval by the Organization Administrator or the registration of ineligible members. The responsibility for approval lies with the Organization Administrator.
⑤ The Company may restrict or terminate the authority of an Organization Administrator in the following cases:
- Exercising approval authority based on false or inaccurate information
- Causing harm to organization members or the Company by approving ineligible members through intent or gross negligence
- Violating the Terms and Conditions, laws, or Company policies
- Other cases where the Company reasonably deems it necessary
Article 7 (Membership Withdrawal and Disqualification)
① Members may request withdrawal from the Company at any time, and the Company shall process it in accordance with relevant laws.
② If a Member falls under any of the following cases, the Company may restrict, suspend, or revoke their membership:
- Providing false information at the time of registration
- Infringing on the rights or reputation of others or interfering with Service operations
- Engaging in conduct that violates laws or these Terms and Conditions
③ If membership is revoked, the Company shall notify the Member and, if necessary, provide an opportunity to explain.
Article 8 (Obligations of Members)
① Members shall comply with relevant laws, these Terms and Conditions, and Company notices, and shall not engage in the following acts:
- Providing false information
- Misusing the personal information of others
- Infringing on the intellectual property rights of the Company or third parties
- Collecting information through automated programs, crawling, etc.
- Posting profanity, verbal abuse, obscene or illegal content
- Interfering with the normal operation of the Company
② If a Member violates this Article, the Company may take measures such as restricting Services, terminating the agreement, or claiming damages.
Article 9 (Purchase and Payment)
① Members may order products on the Site, and payment is made through the payment methods designated by the Company (credit card, simple payment, bank transfer, etc.).
② Payment is securely processed through Korea Information & Communications Co., Ltd. (EasyPay), which is entrusted by the Company.
③ The contracting party for product orders is deemed to be the subscribing organization, and sellers (Wholesale Members) recognize the organization as the counterparty to the transaction.
④ The Company picks up and inspects products based on the organization's order details and ships them to the organization's members through consignment delivery.
⑤ The product prices provided to members may differ from the actual wholesale prices, which may vary depending on the Company's service operation policies, commissions, shipping costs, welfare mall operating expenses, etc.
⑥ The Company shall provide prior notice to Members through the Service screen or announcements when transaction conditions (prices, commissions, shipping costs, etc.) are changed.
⑦ The order is confirmed upon completion of payment.
Article 10 (Delivery)
① Delivery is made by the Company directly picking up, consolidating packaging, and shipping via courier service.
② The delivery period is, in principle, within 3 business days from the order date. However, it may be delayed due to force majeure circumstances such as natural disasters, wholesale market conditions, or courier service issues.
③ Shipping costs are notified at the time of order and are borne by the Member.
④ Even if the Member received a free shipping benefit at the time of purchase, if the reason for exchange or refund is attributable to the Member, the Member shall bear the full round-trip shipping costs, including the costs incurred for the initial delivery.
Article 11 (Exchange and Refund)
① Exchanges and refunds shall be governed by the Electronic Commerce Act and the Consumer Protection Act.
② The Company shall bear the shipping costs in the following cases:
- Products were incorrectly delivered, different from the order details
- Product defects (malfunction, damage, etc.) have been confirmed
- Products of different colors/sizes from those ordered were delivered
③ Exchanges and refunds are possible in the following cases, but the round-trip shipping costs shall be borne by the Member.
- Simple change of mind by the Member
- Other reasons attributable to the Member
- Round-trip shipping costs include the free shipping benefit provided at the time of purchase. The Member shall bear both the cost of returning the product to the Company or the Seller and the cost of receiving the product again after exchange/refund processing.
④ Exchanges and refunds may be restricted in the following cases:
- More than 7 days have passed since product receipt (except in cases of defects)
- The product value has decreased to the extent that resale is impossible due to use or damage by the Member
- The product value has significantly decreased over time
- Products for which withdrawal of subscription is restricted, such as custom-made products
⑤ Exchange and refund requests must be submitted through the Company's customer center within 7 days of product receipt.
⑥ However, if relevant laws provide otherwise, such provisions shall prevail.
Article 12 (Information Provision and Advertising)
① The Company may provide Members with various information necessary for Service use via email, text messages, app push notifications, etc.
② The Company may post advertisements related to Service operation, and advertising information shall only be sent with the prior consent of Members.
③ Members may opt out of receiving advertising information at any time.
Article 13 (Intellectual Property Rights and Post Management)
① All intellectual property rights to content (images, text, designs, etc.) posted on the Site belong to the Company. However, the copyright of reviews and posts written by Members belongs to the respective Members.
② Members grant the Company a free, non-exclusive license to use their posts for the purpose of Service operation and promotion.
③ If posts written by Members fall under any of the following cases, the Company may delete or make them private without prior notice:
- Infringing on or defaming the rights or reputation of others
- Content that is contrary to public order and morals, such as obscene material or illegal information
- Commercial advertising information unrelated to the Service
- Other cases that violate laws or Company policies
Article 14 (Personal Information Protection)
① The Company collects only the minimum personal information necessary for Service provision and complies with the Personal Information Protection Act.
② The Company retains personal information for the period prescribed by relevant laws, such as 5 years for transaction records including contracts and payments, and 3 years for consumer complaint and dispute resolution records.
③ Matters related to the collection, use, provision, and entrustment of personal information are governed by a separate Privacy Policy.
Article 15 (Limitation of Company Liability)
① The Company shall not be liable if it is unable to provide Services due to force majeure events such as natural disasters, system failures, or communication disruptions.
② The Company shall not be liable for Service disruptions caused by reasons attributable to Members.
③ As an online commerce intermediary, the Company does not guarantee the quality, legality, or availability of registered products. However, the Company shall be liable if there are reasons attributable to the Company during the delivery process.
Article 16 (Dispute Resolution and Jurisdiction)
① The Company shall endeavor to promptly handle complaints raised by Members.
② In the event of a dispute between the Company and a Member, mediation may be sought through dispute resolution bodies pursuant to the Electronic Commerce Act and other relevant laws, or a lawsuit may be filed with the competent court under the Civil Procedure Act.
③ The laws of the Republic of Korea shall apply to the interpretation of and disputes arising from these Terms and Conditions.
